The AGA mentioned, "The lack of regulatory oversight presents many risks for consumers as well as the integrity and economic benefits of the legal gaming market through investment and tax contributions. These sweepstakes-based operators have weak (if any) responsible gaming protocols and few, if any, self-exclusion processes."
The Growth and Legal Challenges of Sweepstakes Casinos
Sweepstakes casinos are expanding at a rapid pace, particularly in states where traditional online gambling is not permitted. A recent Eilers report projects that the market for these platforms will reach $5.6 billion in 2023, marking a 66% rise from the prior year. The expansion pace is expected to persist, with estimations showing the market topping $11 billion by 2025. Despite their fast growth, sweepstakes operators have largely avoided significant legal consequences. However, some states are starting to take action.
In Michigan, where sweepstakes casinos directly threaten the state-regulated iGaming sector, authorities have moved to prohibit such operations. The Michigan Gaming Control Board (GCB) has been active in issuing cease-and-desist orders to eliminate illegal operators. Proponents of sweepstakes casinos often compare them to the widely known "Monopoly" promotion at McDonald's, which allows consumers to win prizes through purchases or ticket requests. However, critics argue that this analogy is deceptive. Unlike losing in a McDonald's promotion—where the worst outcome is simply a meal—losing at a sweepstakes casino can lead to severe financial losses, endangering personal assets.
Demand for Regulation and What's Next
Substantial private equity is being directed into sweepstakes casinos, with investors betting that states will either slowly regulate or be compelled to accept these operations due to their rapid growth. This strategy is seen as highly opportunistic and is likely to attract scrutiny from state attorneys general in the foreseeable future. The AGA is calling upon regulators to ramp up their scrutiny of sweepstakes casinos and sportsbooks, urging comprehensive investigations to ensure adherence to state laws.
The AGA stated, "Where state laws and regulations are not clear, legislatures should consider enacting legislation to prevent unlicensed operators from exploiting loopholes in sweepstakes regulations to offer online real money gambling."
Some states have already begun challenging these operators. The Delaware Division of Gaming Enforcement issued a cease-and-desist order to Virtual Game Works (VGW) in February 2023, yet the company remains active in the state. VGW also faced regulatory actions in Michigan, with the GCB directing them to stop their sweepstakes activities for infringing state gaming regulations.
As sweepstakes casinos continue growing in popularity, the need for stringent regulatory oversight becomes increasingly important. The AGA's policy highlights the threats these platforms pose to consumers, the integrity of the regulated gaming market, and potential illegal activities like money laundering.
